JAE STUDIOS LLC LIABILITY WAIVER AND RELEASE AGREEMENT

THIS WAIVER AND RELEASE AGREEMENT (the “Agreement”) is entered into between the undersigned participant (“Participant”) and Jae Studios LLC, located at 1607 Dexter Ave N Suite 2B Seattle, WA 98109 (“Studio”).

PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

ACTIVITIES

Participant desires to engage in fitness classes, dance classes, workshops, and other events (collectively, the “Activities”) offered by the Studio. Activities may include, but are not limited to, group floor exercises, barre, yoga, pole dancing, intimacy workshops, and other enrichment events.

ACKNOWLEDGMENT OF RISKS

Participant understands and acknowledges that the Activities involve risks of serious bodily injury, including permanent disability, paralysis, and death. These risks may be caused by Participant’s own actions or inactions, the actions or inactions of others participating in the Activities, the condition of the facilities or equipment, or the negligence of the Released Parties named below.

ASSUMPTION OF RISKS

Participant expressly and voluntarily assumes all risk of injuries, damages, or loss, regardless of severity, that Participant may sustain as a result of participating in the Activities.

CERTIFICATION OF FITNESS

Participant certifies that they are in good health and sufficient physical condition to properly use the Studio’s facilities and participate in the Activities. Participant agrees to monitor their own physical condition during the Activities and immediately stop participation if they believe continued participation might be unsafe or unhealthy.

WAIVER AND RELEASE

In consideration for being permitted to participate in the Activities, Participant, on behalf of themselves, their heirs, assigns, and personal representatives, hereby releases, waives, discharges, and covenants not to sue Jae Studios LLC, its owners, directors, officers, employees, volunteers, independent contractors, and agents (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, and liability of any kind whatsoever, whether caused by the negligence of the Released Parties or otherwise, for any injury, loss, or damage to person or property which may be sustained in connection with participation in the Activities or use of the Studio’s facilities and equipment.

INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to Participant’s presence at the Studio or participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.

MEDICAL AUTHORIZATION

In the event of injury or illness while participating in the Activities, Participant authorizes the Studio to secure emergency medical treatment. Participant agrees to be financially responsible for any costs related to such treatment.

USE OF FACILITIES AND EQUIPMENT

Participant agrees to use the Studio’s facilities and equipment properly and only for their intended use. Participant acknowledges that the Studio is not responsible for any lost, stolen, or damaged personal property.

NATURE OF SERVICES

Jae Studios provides fitness, exercise, and wellness services through various formats. These services include, but are not limited to, in-person fitness classes and events (such as focus circles), virtual 1-on-1 coaching sessions, workshops, and any other programs offered by Jae Studios, whether delivered in-person or online. While our services aim to improve physical fitness and overall well-being, they are not substitutes for professional medical advice, diagnosis, or treatment. Jae Studios does not provide medical services, therapy, or mental health treatment. Participants should consult with a qualified healthcare provider before starting any new exercise program, particularly if they have any pre-existing health conditions or concerns about their ability to safely engage in physical activity..

ADULT-ONLY PARTICIPATION

Participant certifies that they are at least 18 years of age and acknowledges that the Studio’s Activities are intended for adult participants only.

SECURITY CAMERAS

Participant acknowledges that security cameras are in use at the Studio for safety purposes.

SEVERABILITY

If any portion of this Agreement is held invalid, it is agreed that the balance shall continue in full legal force and effect.

APPLICABLE LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.

By signing below, Participant acknowledges that they have carefully read this Agreement, fully understand its contents, and voluntarily agree to its terms. Participant is aware that this is a release of liability and a contract between Participant and Jae Studios LLC, and signs it of their own free will.
